| Katrina house closing What is the name of your state? Louisiana
We were suppose to close on our house in the NO area on the Wenesday after Katrina hit. Of course we didn't close. We have extensive roof damage, a fence down from a tree falling on it, and had 2+ inches of water in the house. Our realtor advised us that the Real Estate Commission has said, "Any contracts that existed at that time will be honored when the State of Emergency is lifted." We have let our realtor know that we will NOT be handing any insurance money over to the buyers that we will do the repairs. (Was also told that the house has to be in the same condition or better at the time of inspection.) Our realtors' contract expired Aug. 17th so she is pending this sell. What are our rights in this situation?? She is really being pushy as far as trying to get a contractor out there. I haven't even talked with my ins. adjuster. I don't know if it is her or the buyers being pushy. My husband wants to tell her that if the buyers want to buy it "As Is" now for the price stated on the contract we would be willing to do that, other than that we will not go to closing until the work on the house is finished, which could be 6 months to 1 year. It is beyond our control. What options do we have as far as honoring this contract? Do we have the right to tell them they can buy it "As Is" with the original price? |
