Lawyer/Buyer dragging heals??


What is the name of your state? New York Went into contract with a closing date of ‘on or about’ 6/19. Called our attorney many, many times (actually, if I check my notes, it normally take 10 calls to get one call back) and was advised of a closing date of 6/23/03. Closing date was postponed due to the Buyers attorney and pushed out to 6/30/03. Just spoke attorney's office.
I was advised that she cannot get a call back from the Buyers attorney in order to verify the closing date. What sort of legal recourse do we have? From what I can see on my end our lawyer (who is handling our purchase of another property and yet another case for us) has not assigned too much import to anything involving us. What will happen if the buyer of our house backs out?

Contact your attorney and make sure that he gets a confirmed closing date from the buyer..... in writing. Have him send a copy of same to you.

If the buyer refuses to provide a confirmed closing, then instruct your attorney to set the date for the buyer, again in writing. Include a statement that if the buyer fails to close on that date, then you will exercise your right to void the contract due to their breach.

Then, if the buyer breaches the closing, you will have to consider voiding the sale and putting the property back up for sale.
As to deposit refund if needed, read the sales agreement.

Naturally, you have now learned to never agree to an 'on or about' and make it an 'on or before'!!

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

**A: don't you feel compelled to fire this attorney and hire another one? Especially since this attorney is handling the purchase of another property and involved in another case for you?
