Leaking basement

What is the name of your state? Virginia
Purchased a Townhouse in Nov 2002 in Northern Virgina. In the last month a trickle of water appearred coming down the wall in my basement. The basement is unfinished but has some insulation up. As we had more and more rain storms I noticed the water continued to leak into the basement. Upon further inspection (by removing the insulation) I realized that someone had already tried to repair the leak by putting some sort of material on the area. So do I have any legal recourse here since the previous owners never mentioned anything about this or has to much time elapsed since the purchase?

Depending on the age of the house, it may still be covered under an initial 'builder's warranty' or the previous owner may have had a home warranty.

Still, it should have been disclosed by the previous owner, especially if you can prove that they attempted to make a repair before you purchased it.
