Question

leaks


Ever since roof was built-house new 4 yrs ago. If swamp cooler dampers are not sealed we get a leak into house. When we first got leak builder said it was not roof and never to say roof and just to make sure he said he poured water all on roof and there were no leaks. We sealed swamp cooler dampers and this seems to correct problem.
In sellers disclosure we said swamp cooler dampers may leak if not sealed properly - since this is the issue to the best of our knowledge. They did not ask further ques and house was inspected.No ques came up on this. The house is not in Oregon.

1) Do you think this relieves us of any recourse even if for some strange chance it leaks anyway- It hasn't seemed to leak since we sealed it.

2) In a home sale -with any issue- how long do they have to come back with a problem?? Is there a time limit.
We were VERY honest and disclosed all we did.

My response:

1) no because you did not disclose all the facts and the entire history and issues with the builder.

2) there is a time limit but such is based on the disclosure laws of the State in which the property is located in. You stated that the property is not in Oregon so it must be in 1 of the other 49 states.

I do not understand how we did not disclose all info??
We said we had a leak from swamp cooler dampers and it is sealed. To the best of our knowledge that is where the leak came from. Why should we mention builder and him testing the roof just in case??

So how do you find NM disclosure laws???
We filled out a disclosure form and were honest in our answers.
Would love to see laws anyway

let me rewrite my initial ques. as I am still confused.

we had a leak in a new house. Builder tested for roof leak and that was not the cause. The conclusion was that it was a swamp cooler damper. We have had no leaks that we know of since sealed last Oct. We put on disclosure that damper may leak if not sealed.
1) Should this not cover us. Our realtor says it does- since we truely believe this to be the problem.We put it under other concerns- not roof leaks as the builder says it is not a roof leak and a roofer would not fix.

2) How do you look up NM disclosure laws??/

1. since your Realtor knows the laws on this issue, ask him/her for a copy.
