Legal Fees For Lost Lis Pendence Matter - CaliforniaCalifornia In California, if you put a Lis Pendence on real property and lose the subsequent case, is the plaintiff liable for legal/attorney fees? I am almost certian this is true. If so what is the Statue/Code? (RE: The case is Adverse Possession, where the plantiff has filed a really frivilous case and doesn't even meet the bare minimum criteria--not by a long shot). Thanks for your help! |

| In the original lawsuit, ask for damages for the frivolous suit.

| Thanks. I thought of that. I was wondering there is an actual statute/code for attorney fees when there is Lis Pendence and you lose as the plaintiff for bringing such an action despite it being frivilous or not. |
