Lein question.


What is the name of your state? NC
My father owns a house in NC. He made a bad business deal and had a substantial lein put against his house. The leinholders are not from the USA and are no longer in this country.(they've been gone for quite a long time) I would like to get this house refinanced and I don't know what I have to do to get this lein removed. What are my options? Thanks RG

Assuming the lien is still valid, the only way to get it 'removed' is to pay it. Contact the lienholder(s) and negotiate a payment.

The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

There is no way to contact the leinholders. Can I put them on public notice? A banker friend of mine thought that the leinholders have some responsibilty to keep in contact with the lein.

How do you know you have "no way to contact the leinholders"?
What have you done to try to contact them??

I spoke to their x-lawyer here in Charlotte and searched the internet and came up with nothing. Their x-lawyer is 90% sure that they are no longer in the USA.

And what response did you get when you sent a CERTIFIED RRR letter to the address shown on the lien??
If they are truly no longer available, then you will need to hire a local lawyer to get a court order releasing the lien.

You don't just get a 'Get Out of Jail Free' card if you can't find them..... and especially if you don't try as required by law (and logic).

I'm not trying to get a "get out of Jail free" I'm just trying to find out the protocol for clearing this lein. At least I know what direction to take next. Thanks JETX

Probably not. Contact your local clerk or registrars office to get a copy of the lien.

The copy of the recorded lien would show the name of the lienor and their address.

Let say I get all this stuff about the lein and I still can't contact the leinholder then should I get a lawyer and attempt to clear the lein?
