Lemon Law in Real Estate? What is the name of your state? Georgia
We recently purchased a brand new home and have been in the home for a little over 1 month. We have been living a nightmare for the past 30+ days because our builder refuses to address our major issues. Is there such thing as a lemon law in real estate?
To explain, the first week we were in the home, our basement flooded due to a faulty A/C condensation pump. It didn't filter the water out of our house and ended up in our basement. When they came out to clean up the mess, they discovered that the red, Georgia clay had not been cleaned up before the carpet was laid, so we ended up with red clay seeping up through our new off-white carpet. It took them 10 days to come back and clean up the mess. Now our drywall is all moldy and they have not replaced it. Then the garage flooded forcing water to flow under another section of dryway, flowing under the stairway and molding that drywall. Again, nothing has been done. The back yard has become a 12 foot riverbed with all of the rain. They have tried to fix it 3 separate times (all the same way) and all 3 times it has washed away. Now we have rebar sticking up through bails of hay creating a major hazard in the yard. Our children cannot go back to play for fear that they could fall on the rebar causing serious injury or even death. The water flows from our backyard, along side our house out to the street where it then flows over the street causing a hazard. There is a 10 foot drop off on the other side of the street and when all of that water flowed over the street into that dropoff, it erroded away the dirt causing our water main to break. We were without water for close to 24 hours. Now our septic system/tank is faulty. We have raw sewage bubbling up through our front yard, yet another hazard. We still are waiting for paint from the builder to finish painting the house that was supposed to be done before we closed on the house and wasn't. We have bubbles in our linoleum, our hall shower moves when you stand in it and none of the screens fit our windows. Our 10 foot deck was nailed together instead of screwed so it sways when you walk on it and it's not level.
What can we do? Obviously we've already closed on the house and have already made one mortgage payment. What recourse do we have on this property????
