let the buyer beware?


What is the name of your state? Montana
I bought a 20 acre tract of land in a subdivision. The land company showed me a map that showed powerlines running to the property beside mine. The power company said that there is no power there and that if I want power to my property I will have to run the line all the way up the road from where it currently is located. If I can't get the other owners to go in on this, I will be responsible for the whole price.....three times what it would have been if the power was located where the real estate company map showed it to be. Is this misrepresenting a property or is it let the buyer beware? Do I have any recourse?

The seller of the land has nothing to do with what the power company will or will not do. Thus, it's between you and the power company to determine how the electrons will get to your land.

I understand that the electric co-op can choose where to put the powerlines. My complaint was that the land company stated this was a wonderful building lot because the power had already been run to the lot right beside it (which is also a lot in this subdivision that they sold.) The map they gave me was of the whole subdivision and shows that the power was already run, which it was not.

A: This is called "puffery" which is the socially-acceptable word for bullsh*t. The sellers have no way of influencing the decision of the power company.

A: Upon your inspection of the lot, did you notice whether there were lines to YOUR lot? I suspect that the map they gave you showed easements, but that has nothing to do with whether the electric company will actually use the easement.

Unless you have a written guarantee from the seller to you stating that you do or will have electricity running to your lot, then you have no case.
