Listing Agent Commission


What is the name of your state? NJ

We listed our house 4 days back with this realtor after agreeing to give 3.5% commission (2% to go to the buyers agent). The MLS listing agreement says about 3.5% where both me and the agent signed.

Today, we signed a contract (within 4 days of listing) for the home and would be going to the attorney review process from tomorrow.
In the contract, which is supposed to be the legal document for the whole deal, says about the 2% to the buyer's agent and my agent left the space empty for the seller's agent's commission. When I asked him, he said, 'why should someone else know, how much I am getting paid for the deal ?'..

I asked him about the 1.5% which I would give him, he said, everything is there in the listing agreement (which is the MLS listing agreement).
I dont want him to be negotiating to me at the closing table re his commission. Can I ask my attorney to put in the 1.5% in the contract itself so that I am covered and no negotiations would come up later..?

I know there is a chance (maybe very remote) of him negotiating saying that ' I sold ur home in 4 days and got a good price also, why dont u give me 2% instead of 1.5%'...

If I put in this on the contract, would I displease my agent ???

Give your agent a choice, either 1.5% or "o" goes on the line for Selling Agents Commission. If he's smart , he'll pick the 1.5%.
