Question

minnesota, we asked to cancel our listing agreement in writing because our house is no longer for sale. realty company will not cancel it, realtor said their legal counsel advised them not to because we could sell to a 3rd party. what are our possible repercussions by not having our listing agreement canceled? why won't they cancel it? it is an exclusive listing agreemet with the right to cancel, need the realtors signature also to cancel and they refuse to sign cancellation. Our sign is down and our locks are changed, they will not remove lock box.

That company and their attorney is full of crap. You have a right to cancel subject to the terms of termination on the listing agreement.
Send them a cerified RRR letter putting them on notice that the listing agreement is cancelled and to remove the lockbox within 5 days.

thank you very much!!! our house isn't for sale anymore to anyone due to nightmare caused by realtors and we were worried they would bring us a buyer offering full price. since all offers would be refused we thought we would be liable for a commission to real estate company.

Question

it's me again.... sent RRR certified letter telling them house was not for sale and to cancel listing agreement. It expires 06/06/01. Realtor called, said per legal counsel they will not cancel contract, need to let it expire. Asked them to remove lock box, won't. I changed the locks on my house. Asked them to pick up sign, laying on ground. Haven't done it. We are the ones who withdrew our offer because the earnest money check bounced. Regardless, cannot sell house because of possible litigation. Even though our offer was withdrawn, it is still listed in MLS as a pending sale. What is going on? Is there a reason they will not cancel the listing? Was hoping to let sleeping dogs lie but now we are debating on suing broker for lost job, fiduciary responsibilities, stress, and attorney fees. thanks

Ok, now you have to hire your own attorney to level the playing field.
Find one that sues real estate agents and wins.
