Question

I live in PA and I have signed an Sales Agreement with a lady in Novemner of 1999 and they originally gave me $3,000.00 for the downpayment and first months rent signed by Mary Fair. Since then I have not received a DIME. Now we are in debt up to our ears in attorneys fees , but here is the real punch which I am not sure of , The contract is made out to Michelle Payne and Micheal Payne and the notary signature is MARY Payne and as I have found out now all of her other forms , documents , IRS , SS , and disability is under MARY FAIR.
We have done all of the legal documents for forecloseure and she is defending herself and has not shown up at one pretrial , then said she had to have a life threatening surgoury at the next (which I investigated and this was no the truth , she did have a surgorey , however it was not life threatening and there were no restrictions on her medical record) , and now we are in for a third pre-trial this month. Needless to say I am certain she will not show.

Question - I spoke with some other folks today and they asked why we did not file a "Eviction of Mortgagee"in front of a DJ instead of the long route to go to court. what is this and can I still file this in PA for a faster way to get these idiots out of my house and be able to sell or rent the home to someone else.I did also ask my attorney along time ago about eviction and he stated that I could not evict , this was strictly a forclosure. Please help with any information that you may have to get these frauds out of our home.

What a payne in the assets. Hire an attorney and get things done right. The money that you saved in not using an attorney when you first sold the property to the pains now needs to be used.

I can feel your Payne.

I agree and I have made an appointment today , could you please tell me can I go to the DJ and file a "eviction of Mortgagee" , I was told that I could , however we are into the civil suits and I am not sure if I am too far in this process to do that. If they stay one more day longer than I have to legally allow them to I am gonna be mad.
Thanks for your help , I really appreciate this.....

You have to continue the foreclosure action to terminate the contract.
Such action would include demand for payments in arrears and return of the property to you.
Don't get mad, get even.
