Mobile Home title PROBLEM!


What is the name of your state?Minnesota

I bought a mobile home from a family friend about 2 years ago. About 3 months later I made the final payment (contract for deed) to seller, who "went to the store to make copies" and never returned.

I have since checked the title on the mobile home. It is not, nor never was in this womans name. To the best of my knowlege, she never transfered it when she origionally bought it 8 years ago.

Current "title holder" is nowhere to be found. "seller" is also gone. I am currently bound to a lease for the lot where the mobile home is.

I tried to have it destroyed, and they wont do this without a title. I also checked to see if I could sell it, and again.. not without a title.

I bought a home (real home lol) and have about 6 weeks til Im supposed to move... not entirely sure what to do. If I leave the mobile home here, the lot will sue me for each month it is left...

Any ideas?

huh?


Why does that make me stupid? The only thing I failed to do is to *doublecheck* the title situation... This is the 1st home I ever bought, and she was a family friend (so I thought).

Didnt realize the board-trolls were here as well =( Too bad.. this could of been an interesting forum to check out

Yep. Contact your local DMV office about trying to get a replacement title.
From the MN DMV Site:
"Vehicles with No Proof of Ownership: When tangible proof of ownership cannot be established, and no record of the vehicle can be found on file in the central office, (vehicle records are maintained for a seven year period), the following items are required:
* A Bill of Sale, signed by the seller, providing a complete description of the vehicle (year, make, model, and vehicle identification number), the name of the purchaser and the date of sale. All owners must sign. Purchaser must complete an Application to Title/Register a Motor Vehicle (PS2000).
* A statement of facts, written and signed by the seller of the vehicle. This statement must give as much information as possible regarding the history of the vehicle and indicate why there is no documentary proof of ownership. It must also contain a complete vehicle description (year, make, model, and vehicle identification number).
* A signed statement from purchaser that s/he agrees to defend and protect the State of Minnesota against any and all future claims of ownership.
* Photographs showing all sides of the vehicle (photographs are not required on utility trailers with a gross weight of less than 6000 pounds).

Note: The Department may require that the purchaser obtain a surety bond to protect the State against any possible claims of ownership."


If they refuse, you may have to get a local attorney to help you present your issue to a court and see if the court will issue an order for a title to be issued.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Mobile Home Title Problem


You need to seek legal counsel immediately. Why didn't you verify that title was in this "so called" friend of the family's name ? Did you have a contract with this person ? How have you been making payments ? Cash ? Check ? And do you have receipts for the payments made ? Again, you had better get yourself an attorney. It doesn't sound like you have a leg to stand on. Friend, family, or whoever, ALWAYS check things out and get it in writing and get receipts for your payments. If not.....guess what could happen ?!

yea.. I wrote out what I consider to be a pretty good contract.. outlining everything, etc.

She moved out of the mobile home, and we paid 80+% of the total price at that point. She came back to my house 3 times. Two of those times I got a reciet. The last time she went to kinkos to make copys of the final payment, etc, and never came back. She has been in contact with my brother, and has said that basically she doesnt know why it isnt in her name, etc... but it unwilling to go to court, or to try to find the "real" owner.

I have tried to find legal council.. the 3 laywers I have spoken to all say "I dont handle that.. talk to..."

I apprecaite the DMV listing.. ideally I could file this in court myself. If the origional owner was to "show up" and ask for the mobile home.. lol.. she can have it

SIDE issue. I talked to a mobile homer reseller.. who says for $1500 he can "get rid of it" for me. Think thats smarter to do then to try to get title, just to destroy the mobile home?

one last thing..


I agree that the $1500.00 would be far cheaper than obtaining an attorney and going through the courts to try and solve this matter. But, another thing you have to be aware of.....BE CAREFUL about disposing of property which does not legally belong to you !!! You may have paid for it, but it is still not legally yours. You may have to fill out some paperwork at the DMV so that they can take the proper steps for Abandoned Property. Don't get yourself into trouble, just in case the legal owner does step forward and says "hey, where is my home ?" Something to think about !!! Good Luck !!
