Need to sell house


What is the name of your state?VA

We signed a contract with builder ,with a clause that says it is not for investment purposes , we liked another house and bought it to stay, we did not withdraw from the contract with the builder and closed on the house recently.Now we would like to sell the house.Accroding to the contract we signed we cannot sell the house before 12 months , can't rent it either.The sales person at that time said verbally they do not care bcoz situations can always change.Can we legally sell the house?

try it, I doubt they would stop you, but you need an attorney


You see if they seek an injunction it will cost them money with no gain. Also you may want to research if that provision is really just total BS. Since they arent licensing the house to you, you own it how can they have any further control outside of the cc&r's and HOA's. If you dont put a sign on the place they may never know you sold it, keep it stealthy. Low key.

Thanks for the reply .So you say what we signed is not part of CC&Rs? How do i find out what the deed restrictions are? We have a rental agreement for the current place we have , but we are reluctant to move because i am pregnant and will be delivering soon. How will a lawyer be able to help us out in this?

**A: yes, you can legally sell and the developer can legally sue.
