New Const w/fail to disclose??


What is the name of your state? NC

We found the perfect house and area. After looking and relooking we finally decided to sit down and talk price/timelines etc. Walked away happy campers w/sales agreement in hand.

Now we find a realtor. What?? we shoulda had one at signing!?? YES WE KNOW NOW! HEEEELLPPPP When we sat down to buy our new construction, she didn't even so much as mention realtor until we were already signed and walking out the door! Then she gave us a card of her friend!! --problem 1, cuz when I called to have our realtor added she refused, I called the 'big wig' he refused.

Now that we are 'stuck' with our current house that wont sell, preapproved for more than the house will cost us to buy, we have no way out of our contract without losing our 'earnest money'. Even if we were denied a loan for new house, the earnest money would stay in there pocket.

I am wondering somewhere out there there has GOT to be a loophole that specifies that the Seller HAS to advise you that if you don't have a realtor when you sign these papers, that you can't add him later. ALSO, that the words "If construction of improvements has not commenced... " blah blah that the words "construction of improvements" are the INSIDE (cabinets, floors etc) and not the structure itself.

The realtor would have known to ask the specific questions of bottom line, how much we will they lose if our house doesn't sell! Then we would have known right then and there to walk away rather than risk $3,600!!!

At this point you don't need a realtor. You need to take the sales agreement to a real estate attorney.

And the attorney should have reviewed the contract BEFORE you signed it.
