New Home Purchase-Bad Pool Heater


What is the name of your state? New Mexico. We just purchased a home in Albuquerque. The home is 25-years old with an in-ground swimming pool and spa. The home was advertised with a heated pool. 2-weeks after moving in we had a pool company open the pool and spa for the season. The pool guy said he couldn't and wouldn't start up the heater because it was unsafe. The former home owner gave us a pool inspection report and it said the heater was hard to start. During negoaiations we asked that the heater was repaired before we closed. They sent out a plumber and he oiled a start button and started the heater. The problem is the heater is shot due to internal corosion. A new heater will cost $1,500. Can I get the former home owner to pay up?

**A: no, you should have had the heater inspected and tested prior to closing using the company that you hired 2 weeks after moving in.
