No convenant when we were told there wasWhat is the name of your state? Alabama We bought our house believing there was a convenant, but have since found out there really is no convenant since it wasn't registerd at the court house. This wouldn't be a big issue except for one of our neighbors is not cutting his grass (about 2ft high), and some others things. My questions is, do you we have any legal ground to stand on since we where told there was a convenant and were given one at closing? |

| No. First off the seller would need to know that the covenant was defective to be liable. Second, you're not "damaged" so I don't know what you expect to collect. Third, the mere presence of the covenant (even if it were recorded) doesn't mean it is enforced or enforceable. |

| Have you tried to find out why the grass isn't being cut? Maybe the other home-owner has health issues; the lawnmower isn't working; he works at night and is too polite to disturb the rest of the neighborhood with the noise; etc.
