non discolsed issues


I bought a home in ohio around Aug /06. Since then the roof has been leaking and caused damage and the basement is now leaking. Both the roof and foundation were disclosed as having no issues. can i seek recourse?

Only if you are able to prove the seller knew those issues existed prior ot the sale.

Has there been any changes to/around the house since you bought? Any big tree branches coming down on the roof in a storm? Have you done any landscaping around the foundation? Paved over any areas that used to accept runoff? Planted a garden that you now water along the home? Any neighbors make changes that may be affecting you? A neighbor pave a drive close to your house that may be directing storm water toward your house.

You get the idea. The fact of some basement leaking doesn't automatically mean the seller failed to disclose it. You need to show it was an existing issue and the seller knew, not just that this is occurring now.

i believe they did, hence the stucco and water stop leak they left in the basement closet. maybe trying to conceal the issue?

i removed a shrub about 5 ft away from the house and a pine tree about 10 ft away from the house. i seal coated the driveway. i also trimmed down some bushes

yes but i dont think anything was said about the foundation. as before they sold the house it looks they tried to conceal the issue, look under the 1st quote for details.


on another note i would also like to add, after a month the roof started leaking through the dry wall, again another issue where they remodeled the room where the roof was leaking to conceal the issue. i paid to have the roof fixed and the roofer stated there was no flashing on the needed area.
