Obligated to take a full price offer?


State: New York

A couple of months ago I put my house on the market in upstate New York. After one week I recevied a full price offer. What this did was 1) tell me that the broker had underpriced the house, as I feared and 2) I didn't want to sell.

Understanding the broker's frustration I offered to help with the ad costs, even though the house was on the market for only one week. Since then I have been presented with a bill for $1200. I'm told that I should be happy this is all because 'legal precedence' is that I owe the commission on the full price offer.

I signed a standard New York Real Estate agreement and did not sign anything regarding the offer. The agreement says nothing about ad costs or that I'm obligated to take a full price offer.

A couple of years ago I made a full price offer on a place and they guy came back asking for more. He wasn't obligated to sell me the place, why am I being told I am now?

**A: there is more to this story. There is no law obligating you to accept a full priced offer. But, if the offer was all cash and free of contingencies, or subject to financing with standard contingencies, you may be liable to pay a broker's commission and/or related fees.

read your contract. does it say something to the effect that you owe the commission if you decide not to sell or if the agent finds you a full price buyer?

read the back of the contract too.

you said the realtor set the price too low? YOU determine the selling price, not the agent. He only advises you.
