occupancy limit before renting


I live in florida and I am trying to purchase a house for an investment. I'm looking at renting it after I do some fixing up on it. I have been pre-approved for a morgage for 107% of the home value (to include paying for closing cost) I have been asked to sign an affidavit stating that it will be my primary residence and I will be moving into the house within 30 days of closing. My intent is to fix the house and rent it, not to live in it. The broker is telling me that nobody will ever know as long I as I don't default on the payments. I however am not comfortable with that.
Is there a statute that states a minimum amount of time that I would have to live in the house before I can legally rent it. Could you please tell me what it is. Could I use it to get out of the contract with the seller and get my earnest money back?? I tried to get the loan as an investment property but lender requires at least 10% down plus closing cost which I can't afford at the moment

This is not a State issue but a Federal issue.
Do not commit fraud by signing the o/o affidavit.
Terminate the contract.
