oral contract in real estate sales?In Texas, an oral agreement of a sales price for a home does not constitute a contract, right? Doesn't Texas mandate that real estate contracts be in writing? What are the consequences if a seller backs out of an oral agreement witha potential buyer? (only price was agreed upon and no realtors or brokers were involved) Thanks! |

| Q1) "Doesn't Texas mandate that real estate contracts be in writing?" A1) Correct. Texas (as most, all??) states requires that any contract for sale of real property MUST be in writing. Q2) "What are the consequences if a seller backs out of an oral agreement witha potential buyer?" A2) Nothing. The fact that it was NOT in writing means that a binding contract didn't exist.
__________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |

| To add to Halket's excellent answers; pursuant to the Statutes of Frauds, all real estate contracts must be in writng to be enforeceable. |
