| Personal Property disposition after clsing What is the name of your state? North Carolina
I have closed on a house, and the sellers who have moved to another state have yet to remove a good deal of personal property not specifically mentioned in the contract. The sellers have stated due to their financial situation are waiting to "pick up their items" when they have the money. (They moved to Texas). They have also said they are trying to sell some of it via various methods(i.e. ebay, craigslist). I have tried to be understanding of their situation, but I really have no room to put my furniture and such while storing theirs as well. I have read my contract (standard NC contract as I am told) and there is nothing stating that I have to continue to hold it for them other than good conscience. There was also no signed agreement stating I would hold their items either. However at the final walkthrough their agent stated to me their intention to remove their items soon. I do not believe me saying ok to that constitues a binding agreement. While I do not want to be the bad guy and remove their items I feel as though after a certain point I should be legally able to remove their items without fear of legal reprisal. My research has led me to believe that as soon as the papers were signed at closing, and without any written agreement, their property became my responsiblity. Can anyone please offer some insight to this matter. Thank you in advance. |
