Playing the waiting game- NJ


What is the name of your state? NJ
We currently have a contract on our home since early June. The closing date was set for August 1st. We were informed by the buyers agent that they currently have a contract on their home at that this was a "DONE DEAL". No lawyers or agents to deal with. Our buyers were selling to a family friend. We had another contract on our home at the time and was in day 3 of attorney review when this contract came in. Again their agent told me it was a done deal and they had a very large down payment and no contingencies. Well needless tosay he added into the contract at the last second that they neede to sell their home but again reassured me that it was a "Done Deal" his words.
It is now Sept 6th and we still have not closed on our house and there is no closing date set. Every time my lawyer tries to get answers we get told they don't know what the delay is.
My question is can we throw these people out without any legal recourse?? How long can we be expected to wait??? In the meantime I have spent every dime we have getting our house ready for sale and spent our savings on making mortgage payments we didn't expect to make. Please help!!!

How are you expecting strangers on the internet to help you when you have an attorney who knows the situation and is familiar with your case?

I thought that this is what this forum was about to get some advise and possible help. My lawyer is working on it.

Well since you're from Jersey I'll try to explain in NY terms.

You own a house you are trying to sell.
You own a house you just bought.
Your sellers own a house they have (obviously) not yet sold.
You have some sort of purchase contract on the house you own and are trying to sell.
You have an attorney
you have no facts which are contained in this contract for purchase on the house you own and are trying to sell for which we can base a valid answer.
Your attorney, who has read the contract for purchase on the house you own and are trying to sell, has intimate knowledge of the facts.

Now, am I missing something here? Do you want a pat on the head, a GUESS as to what is contained in the purchase contract or do you want us to read it and tell you where your attorney is failing so you can fire him/her, hire a new one (at additional expense) and start the process over again?

What, beside Ms. Cleo advice, do you really expect when we have no facts upon which to base a decision?

How rude are you??? I tried to be brief . You should have read my post more clearly- but since you are from NY I will spell it out for you. I did not purchase my new home yet since it is contingent upon the sale of my current home. My question was how long can the waiting game go on.
If you are going to be rude don't bother to reply.

It can go on as long as your ATTORNEY tells you it can and as long as the CONTRACT you have says it can.

is that simple enough for you.

What BB is trying to tell you is that your attorney has the information (contained in the contract and in his head from dealing with your buyer) needed to answer the questions. You gave us a chain of events, but no information on which to answer your question.

Here is some of the information needed:

When does your contract state you are to close?
What does your contract say happens if you don't close on that date?
What kinds of extensions/addendumns have you signed?
What direction have you given your attorney?

He were supposed to close on August 1st as previously stated. Unfortunaeatlyy due to the contingiancy there was no date set since I was informed by their realestate agent it was a done deal. I have not signed anything stating that this could go on endlessly.
My lawyer has compelled our buyers attorney to serve a time is of the essence letter to our buyers buyer. We have also asked for more of a deposit to prove that our buyer is still going to buy our home . If they do not comply we will start litigation proceedings on all parties involved.

Also I woiuld appreciate it Belize would not reply to any of my posts since you are so rude and I thought that this would be a forum to try to realease some of my stress over this situation not make more. So kindly keep your RUDE comments tor yourself or just plain get a life!
