Problems with closing


What is the name of your state? WV

My husband and I are having a problem with out loan officer, she will not return our calls or our realtors calls on a closing date. She has given us 4 different dates that we were to close on, how ever when it comes to the day before it, well call to make sure and she says she can't close or doesn't even bother to call at all. Out first closing was to be on april 1st, then april 4th then 10th , then the 14th. Everything is in order for the closing and all. Now when we or our agne calls her to find out a definate date to close she will not return our call. We had to give notice to our landlord that we would be moving out on the 24th of april. he has a new tennant moving in on the 26th. I did call her today and she said that the person that gives her the go a head to close on a house is out of town, and all we have to do is wait till shes back which is supposed to be in 3 weeks. Our problem is that we have to be out of our house by the 24th of april, and myself, my son and my husband have no where to go. Our parents live 12 hours away from us. Do we have any legal rights to this at all, or should we get a different loan officer, and if so will this delay the closing, or should we just sit and wait?

**A: what is the loan status? Has the appraisal been completed yet and all conditions met ie. prior to doc and prior to funding? It appears that the loan is still in the underwriting stage. Is there anyone else that can work on your loan while the person is out of town?

This is inexcusable. It sounds like the underwriter is out of town for 3 weeks. Go over this person's head. Go to the supervisor or the president of the company. Threaten to take your loan elsewhere. Make them pay for your hotel room. I had a lender consent to reimburse clients for a hotel room because it was the lender's fault for the delay.

If your appraisal has been done and another lender will accept that appraisal, then see if you can take the loan somewhere else. It may be difficult getting your current lender to release the appraisal, but if you make written demand, they have to give it to you. Its your's, you paid for it.
