Profits From the Sale of Our Home


What is the name of your state? California.

My soon to be ex-husband and I are at odds about the profits of the home we're about to sell. The state of California says that we split it equally, but my husband says we were only married for 12 years and he owned homes way before that so he should get way more profit from our home than I do even though I will have custody of our children.

Background--My husband has a drinking problem. He verbally abused me and my 16 year old daughter. When he starts drinking, he can't stop. Then when he has had 6-8 glasses of wine he thinks he's fine and insists on driving home. He's had a problem with drinking and driving since I have been married to him. I am mainly concerned about my children--Cindy 11 years, Robert 8. I am forced to go to the Family Law Facilatator because of money problems. My QUESTION is--IN the paperwork, is there a section or place where I fill out concerns about my spouse and when he has the children. I want the courts to know he has a drinking & driving problem. How should I deal with this?

what your husband says he SHOULD get doesn't matter in any way. If the courts said to split it 50-50 then you get half the profit no matter how much he complains. His past record of owning homes doesn't mean anything also.
