Question

qut claim deed info


My friend is trying to purchase a duplex rental property from someone who has a child support lien, I told him not to buy the property until he finds out if the property has a lien against it for the child support.
My friend also is considering going into real estate business with this same individual but wants to obtain a LLC status so that he is not financially responsible for this other person's debts, my question is can this other individual obtain LLC status knowing he has a child support lein against him and any propety that he has?

You are correct and your friend is an idiot.

The PROPER way to buy any real estate is to FIRST get an accepted offer, with continguencies re: title insurance commitment (which the seller pays for in WI), survey, inspection, municipal status letters, code compliance letters/inspection, then make certain to read everything that is against the real estate, and have all matters cleared by completion of closing. A purchaser is entitled to a WARRANTY deed, not a quit claim deed. And the title company closing agent can pay off any CS liens at closing- so your friend can still write an offer subject to review of title (and the WB11 Offer has the verbage for that requirement preprinted).

A purchaser is nuts to allow the seller to give them a QC instead of requiring seller to give them a Warranty Deed.

If the seller has any lien attached to their interest in title, they cannot negate that by now transferring their interest into some other entity.
