Question about leaking roof


What is the name of your state? PA
I have a question on a leaking roof and I was wondering if anyone could help. My fiance and I settled on a house in December 2002. In the sellers disclosure the roof on the residence was listed as 1 year old, replaced buy the home owner. Five days after settlement, the ceiling in the family room began to leak, and several times after that. Upon inspecting the area of the leak I noticed that a piece of tape had been placed over a hole and painted over. An obvious attempt to cover a leak problem. I have had several estimates done and all companies are telling me that the roof was not done properly(nail pop ups, missing flashing, etc.) and they recommend replacing the roof the right way. My questions would be: Who is responsible for the repairs on the roof? How long do I have to seek restitution? Do I have any legal ground to stand on should this matter go to court? Who should I be contacting on this matter? Any help would be greatly appreciated.

**A: did you get a home inspection before you bought the home? Was the roof a 1 year old roof?

The home inspector stated that the roof appeared to be about a year old and that there were no obvious problems with it. However, every roofer that looked at the roof(even the ones I know) said that it was obviously not done properly the first time around, and that it needs replacing.

Then you may have a cause of action against the Seller and home inspector.
