Question

Question about Seller Disclosures


What is the name of your state (only U.S. law)? AZ

We are currently in the process of purchasing a multi-dwelling property.
The seller has disclosed a certain number of chattels (fridges, A/C units) on the Seller Disclosure Statement and has signed the contract with the same numbers stated.

Now, the seller has emailed his agent and has said that there are actually less chattels than disclosed. The dwellings are currently tenanted and the Seller has said (by email) that some of the chattels that were disclosed actually belong to the Tenants.

What I would like to know is what are our rights as Buyers?
Are we entitled to the possession of the chattels as listed on the Seller Disclosure and the Sales Contract?

**A: youa re not entitled to property that belongs to the tenants. Although you have a claim for the depreciated value of the appliances that you thought you were getting via the contract inventory.
