Oregon The trustee (Bank) on a property which I have placed an offer on (as a buyer) has countered the offer accepting all terms with the exception of this clause: Assessments: if any, that benefits the property and shall provide benefit to the property post closing shall be prorated between Seller and Buyer. Question: The word "post" in this clause is disturbing, can this be enforced in a court of law ? Any advice is greatly appreciated. ![]() |

| "The word "post" in this clause is disturbing, can this be enforced in a court of law ?" *** Of course it can. And it is not an unusual clause. Simply, they are saying that if there are any 'benefits' (assessments) after closing they are entitled to their 'share' of them.
__________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |

| I would not agree to such a clause as there is no time limit. It could be enforceable 100 years later. |

| Good point. Add a time limit to this clause.... start 'within 3 months of closing' and increase to an acceptable time limit if needed.
