Real Estate Agent Question


What is the name of your state? NY

Long story short...found a buyer on my own. Was fighting with agent about commission split. They wanted full 4%, I wanted to give them 2%. As soon as the deal I found on my started to evolve, the agent stopped showing my house and took down their sign from my lawn.

The deal has since gone dead. I tried to find a new agent, but my house is still listed on MLS with the old agent. Contact has been re-established with the old agent and they are unwilling to dissolve the original contract.

Can do this since they took down their sign, pulled all their ads and stopped showing my house?

What does your contract require? Most sales are made thru MLS. Usually, if you have a contract, you have to pay the commission even if "you found a buyer on your own" because who's to say how...

I want to use the services of an agent. My questions is am I obligated to use the old agent even if they took their sign down, pulled online and offline ads and stopped showing the house?

Contact the broker that your agent works for. Demand that the agent either live up to the agreement and start showing and advertising the house or else immediately release you from the contract.

Read your contract with the agency. Make sure you understand the commission and time frame sections.

P.S. Not that it matters now, but I would expect that accoring to the contract you would owe the full 4% for the dealer that never happened - despite the fact that it doesn't seem fair with you doing the work.

The listing is owned by the agency not the Realtor who listed it. You can always ask for a new agent to be assigned to market your home.
