I have a home on Ohio. Here's my question. I entered into a contract in Jan 2001 to sell my home with a local real estate company. I interviewed several agents before selecting the one I did. Last Sunday we had a open house and the agent left a note on the dining room table that she has some family troubles, that they live in Alabama and she was going there. She had hoped our house would have sold before she left. She gave us a name & # of another agent in her office that would now be our agent. Can she do this? Can I cancel the contract with this company?

Yes she can do that. You signed a listing agreement with her real estate company and not her. Although I am sure that your choice was based on her and not her company. Talk to her principal broker to see if you can cancel the contract.

In Kentucky the buyer of seller can not hold the Real estate company responsible for the actions of their agents. The Real Estate agents are so called ( Free agents) meaning you can not hold the Real Estate company liable for their agents actions. The law here in Kentucky is very relaxed on Realtors. I could expound on the subject.

I wish to clarify a few issues. In Kentucky, and in ALL other States, the real estate licensing laws mandate that the designated principal broker is responsible for the actions of their agents. In addition, ALL Realtors (in all 50 States) are mandated by the exact same Code of Ethics. So there are no relaxed State licensing laws (that waive principal broker liabilty) and Code of Ethics just because the Realtors are from Kentucky.
