Realtor broke code of ethics


What is the name of your state? TX

I signed a contract with my realtor on August the 4th. We had previosly had our house listed with another realtor. We moved out of our house to Alabama in October and received a few phone calls that they were showing the house and that was it. At the end of November we received a message that he had a offer. When we called the offer was way lower than the listing price. While in their possession someone done some damage in our bathroom and we had to repair, some one drove onthe property where they shouldn't of and busted a water line. Costing us quite a bit for water we didn't even use. My best friend sold her house and asked if she could rent our house. So my husband and I decided that was in our best interest. When we called the realtor to let him know we wanted to rent the house and take it off the market he somehow had a offer for our listing price and we didn't leave him a number contact number that's why he hasn't gotten with us on this offer. We'll if we didn't leave him a number how did he contact us previously. So he is telling us that he is contacting his attorney. We are working with him on that so that doesn't have to happen.

This morning as the rentors are moving in he shows up telling them that we are screwing them over and that they should talk us into selling and then they could lease from the new owners. He also informed our friends that we were bad people and he just thought they needed to know that. He told them we breach our contract and he was taking action. Finally, he was asked to leave.

My question is we were willing to work with him and he knew that and we are supposed to call him Monday. So, he went to a third party and diclosed that information and slander our names in public. Threre were people installing equipment in the house at the time. What can I do about this? Our contract states that he may not violate the Real Estate License Act. He is also a member of the REALTORS of Texas and they state this as misconduct in there articles.

Stated in the contract, since the broker was representing the seller and the buyer, the broker was to not violate the Real Estate License Act. Well, I found this Act and he actually did violate this so does this get me out of the contract?

**A: the broker must follow the provisions of the law even if representing only one party. There are even more porvisions in the law covering dual agency, which you had.

Well, I found this Act and he actually did violate this so does this get me out of the contract?

Question

I spoke with my realtor tonight and informed him that I had been in contact with the Texas Real Estate commisson and the Texas Association of Realtors both to which told me that I had a case. Upon speaking with him of course he denied everything that happened. I will be talking to a mediator tommorow and maybe we can resolve some issues. Would it be a good idea to get all witnesses to sign affadavits to what was said to them? :

How can I get the forms and get htem out ot everyone involved and them completed legally. I want to mfake sure the inforamtion I collect is legal and valid in court if this get that far.

You don't need forms.

Just have everyone write in plain and simple English that is clear and concise what happened and when.


Then have them sign it in front of a notary public.

I just received a letter from the realtors attorney saying he is filing suit but we have the option for mediation first. I have a free advice attorney from the realtors association but she left me a message and hasn't called back. I just would like this resolved. How should I aproach this try to get all the information that I need before the mediation? The lawyer states our breach of contract but never mentions in wrong doing on the realtors behalk of course. He broke the confidental information part of the contract. Please, let me know what you think.

In the realtors, meaning they were the only people that could get in and out of my house.
