realtor extended MLS listing after expiration


What is the name of your state? TEXAS

We listed our home with a realtor, the original contract shows the listing as expiring on June 1. On June 2, the Realtor faxed us an extension agreement which was signed and returned on June 3. The listing now runs through August 2. We have asked the Realtor to terminate our agreement for dissatisfaction of service, and he refuses. The signed document from June 3 is clearly marked as an 'addendum' to the existing contract (which was in fact expired). Would we now consider the addendum void for that reason?

**A: no, the addendum is an extension of the contract time period and enforceable. Send a certified rrr letter to the principal broker demanding immediate termination of the listing contract and list the reasons why. Request a return confirmation letter back within 10 days.
