Realtor issues


What is the name of your state? Oklahoma

I listed my home for sale in August on a 6 month contract with an agent. Since then we have received a couple of offers below asking price with contingencies which we turned down. However, she calls this weekend and verbally gave us an offer above asking price with a stipulation that we had to be out by Dec. 30th. She was told I would have to talk to my family and I would call her back. She said she needed an answer by 1:30 on Monday. I called and left her a message to call me. She called me back after the deadline with an attiude stating that she was going to bill us her fees that we intentionally let the offer expire and we now owe her $12,000 in fees. I'm stuck I have other people saying she can't do that, but she says she can... Do I need a laywer and is she right?

How does she know you INTENTIONALLY let the offer expire? IMO, she's blowing smoke. She needs to bring you a full price offer (which it was) with no contingencies (ready, willing and able buyer) to possibly collect a commission. How do you know the buyer was "able"? If the offer expired at 1:30 on Monday afternoon, the buyer was no longer "willing".

That's what I thought. I just don't know the legalities of the contract we signed with her to sell the house. According to her because she got us an offer for asking price we are obligated to sell if we refuse the offer we are obligated to her legal fees...

**A: she is full of crap. Complain to her principal broker. Offers must be in writing anyway. If not, you have no obligation to respond.
