refinancing and paying penalties while my husband is deployed

My husband and I are going to refinance our home. Because we are doing it sooner than later, we have to pay a penalty. My husband is deployed in a "hostile fire" zone. Does this make us exempt from paying this penalty? Thanks!! What is the name of your state? We live in California.
