Removing name from home loan


What is the name of your state? nevada, but the property is in utah.

nine years ago i made the huge mistake of co-signing with an roommate/friend on a loan for a mobile home. before agreeing to co-sign, we agreed that if one of us was to move or get married that we would either sell the house or the person remaining would buy the other out or take over the payments and have the others name removed from the loan. having been friends for several years i thought i could trust this verbal agreement and we didn't have our agreement legally documented. problem!

three years ago, i moved to las vegas, nevada to live with my present partner and my ex-roommate promised that she would remove my name from the loan. She still has not done so and has in that time made a number of late payments that have shown up on my personal credit report. i told her this summer that if she didn't take immediate action to remove me from the loan obligation, i would seek legal assistance. she has still not done so. do i have any legal grounds to force her to remove my name off the loan and is there any way to get her default payments off my credit record? my partner and i would like to purchase a home in the near future and i don't want my credit to get in the way. also, it is causing a lot of stress and tension in our lives. please help!

Before you seek an attorney you should talk with the finance company. If your income was used to help secure the loan, it is doubtful they will want to just remove your name.

**A: does the mobile home include the land? If so, file a partition action.
