rent back


What is the name of your state? CA
i am a first time homebuyer and closed escrow on october 31st. a condition of the sale was that i rent back the property to the sellers until january 23rd. we signed a rental agreement that stated the rent would be $1500/month for each full month and $50 per day on pro-rated daily basis until jan 23. the term as stated in the rental agreement is from close of escrow until jan 23. the sellers and their agent are now telling me that they are owed 3 days of free rent and that they are not moving until the 24th. they say that the original purchase contract gave them close of escrow plus three days to move out and turn the property over to me, but that since they didn't use the three days when escrow closed they are going to use them at the end of the rental agreement. it was my understanding that the rental agreement took precedence over the purchase contact. how is it possible that they can do this? can they just decide to use that part of the purchase contract at the end (by the way it only gives them 2 days) and ignore the rental agreement? If i'm right and they can't do this how do i collect the $200 rent for these 3 days plus the rent for the 24th. what can i do about their agent who is giving them this information?

Tell their agent to discuss it with your attorney.
