requesting a summary judgement


I live in NYC. Sold my home on a contingency to purchase a new home. The problem is two parties were involved in selling the home. Originally the 1st party was not aware that the second party had to sign the deed, because the mother changed the deed without either parties knowing, leaving them both tenants with rights of survivorship. When the error was detected a contract was drawn up between the two parties ratifying the original contract, confirming that both parties would sell there share. Problem; after closing dates were set and contracts signed, the 1st party decided that she was not happy with her portion of the assets that the 2 parties agreed apon IN WRITING.
Hence, a 2nd closing date was canceled.
Currently, we are requesting the courts decision in this matter.
Any legal input?
We are in limbo.
