right-of-way for driveway


What is the name of your state? Pennsylvania.
I am selling a home that is adjacent to county property (an 800-acre park). The driveway to this house (built in the 1930's) connects to the road at an angle which crosses the property line midway, and ends on park property at the road. It has been this way for at least 40 years, and there has never been any fees, contracts, or other agreements required for use of the driveway by any prior owners to my knowledge (I've spoken to the previous two owners). Now that I am trying to sell the house, the county is demanding a fee of $1620 based on 50% of the appraised value of *my* lot...to grant permission to use the driveway to gain access to my property. Do I have any options (legal precedent, case law, etc.) to dispute this unjustified fee ? Thanks

**A: hire a real estate attorney as your issues are much too complicated for this forum.
