Roof Damage

What is the name of your state? Nebraska

On August 5, 2005 I purchased a house in York, Nebraska. All of the paperwork was done by fax or fed ex because I was in Louisiana at the time.

After moving into the house I found out that the roof had damage do to a hail storm in May, 2005. I also found out that the previous owners had received insurance money to fix the roof damage. However, no where in the sales agreement did they acknowledge that there was roof damage.

Is there any legal recourse for me with regards to the roof?
Is small claims court appropriate in this case?

Any information would be greatly appreciated.

**A: what was in the roof section of the undetailed home inspection report and the seller disclosure statement. Post the sections word for word.
