Roof damage on our newly purch. house


What is the name of your state?Illinois

We just closed on a home in IL 7/25/05. The day before closing we received a notice from the city that there was an open permit for the roof - it stated the valleys and flashing needed to be completed (sellers disclosure stated no known defects to the roof and our inspector already alerted us to the valleys and flashing). We had a roofer out to look at it last week and he said the entire roof was put on wrong, isn't vented at all, and has started to cause damage to the joist. He recommends a complete tear-off and re-shingle at the cost of $14,000. We are going to get more quotes, but do we have any recourse against the sellers? We also noticed water spots on the ceiling in the foyer.

Help!

**A: did the Seller's know of the problems?

We aren't sure - they marked "no known material defects" regarding the roof but the roof permit was pulled last year when they owned the house. I'm trying to get in touch with the roofer listed on the permit to see what repairs he quoted them.

They must have known about the open permit but the roofer listed on the permit hasn't called me back (yet?) so I don't know if he told them that the roof needed to be totally redone or if it was a phone conversation between the roofer and the owners with the owners saying that there was flashing/valley work that needed to be done. But I can't believe that the roofer would pull the permit w/o looking at the roof. Hopefully he'll call me back and I can find out exactly what he told them.

I'm assuming the previous owners hired the roofer, but I won't know for sure until I get a hold of the roofer.

I spoke with the roofer - he has a heavy accent so parts of the conversation are lost but I do have him coming out to look at the roof and while he did say he didn't give the previous owners a written quote he did tell them it needed "some work". When I speak with him in person I'm hoping to get more definite info from him.

My question boils down to this; if I can't get anything in writing from this guy saying he told them the roof was bad one year ago are we just SOL?
