We recently purchased a costal vacation home in Maine. The property is landlocked with no deeded ROW. We have entered into negotiations to purchase the adjoining land and allow us access to the street. The house is about 100 years old so the path across the land has been in existence for some time.
About a month after we closed on the property we learned of a lawsuit started by the previous house owner against the land owner to have the deed adjusted to include the ROW.
Apparently the previous owner had started similar negotiations to buy the land but things went sour resulting in the suit. We are being advised that the suit is not closed and we must deal with it. The lawyer representing the landowner has positioned to have us put on the suit.
What responsibilities do we have for the existing suit?
What possible motivation could the landowner have to continue the suit?
Is there such thing as grandfathered access?
