Question

San Francisco Renting Law


What is the name of your state? CA

My parents-in-law own 2 homes in San Francisco, one of which they are renting out to government-subsidized renters. They originally signed contracts with the renters for 2000-2001, then has been going month to month. They have been trying to get their home back from the renters for 2 years (writing notices to renters and govt.) but have heard horrible stories about penalties and lawsuits from renters since SF has one of the strictest rent control law in the country. Hence, they have not aggressively pursue taking their home back.

A lawyer has said that they would have to compensate the renters 2 months rent to help the renters find a new place, but only if the renters agree to move (like an out-of-court settlement) or face a long court battle of which they likely cannot get their home back.

My father-in-law has been laid off now and so may need to sell one of the two homes. Can they never take back their home from renters without losing money themselves? Is SF law so ridiculously stupid that it punishes people who provide low-income subsidized rent to people and then get punished for it?

**A: I suggest you read the L/T law for CA and the specifc rent control ordinance for the county or applicable area. Then if you have specifc questions, please post them.
