Satisfaction of Mortgage


What is the name of your state? Florida
We purchased a home for our daughter which closed on June 12, 2003. At the closing we presented a cashier's check for the full purchase price as a cash transaction. The title binder stated there were two mortgages to paid from our funds. We have found the satisfaction recorded on the first mortgage but have been unable to find where the second mortgage was satisfied. There were a lot problems with the sellers so they will not tell us or give any information. We've checked all the records at the courthouse. All our funds were used to purchase this property so we have no money available for an attorney at this time. If someone could point me in the right direction to find this information I will really appreciate it. Thanks LJRR

**A: tell us you did use the services of a real estate agent and escrow company?

No, we found the property ourselves, my husband wants to do everything as cheap as possible so signed a contract, asked for title insurance and handed the check to the title company at closing. I tried to get him to cancel the contract when we found so many misrepresentations on the property, but he wouldn't. So now, here we are with a daughter and small grandchild living in a place that may have an unpaid lien on it.

**A: now you know that the theory of "as cheap as possible" goes along with the old adage "you get what you paid for"

Thanks for responding. So, in effect what you are telling me is there is no recourse and my daughter is responsible for paying off this mortgage. The Title insurance states there are no liens. Believe me, I would have liked to handle it through the proper channels, but my husband has the money so things are always done his way or no way. Thanks anyway. LJRR

**A: tell your husband to hire the attorney that he should have hired before buying the property. Prior to any closing, prudent Buyer's order a title report and lien check.
