Seller cancles contract on closing day !!


What is the name of your state? NY

Hi, in the afternoon of closing day we recieved a call from our lawyer stating that the seller doesnot want to sell anymore!!! I figure that someone has offered them some cash or more money than us. But is this legal ?? The part that stumps me is that they are refusing to pay any kind of compensation to us ( inspection fees, interest on our deposit 2months, lawyer fees, moving company fees, and not to mention that we got evicted the next day because we had already given notice to our rental appartment. We had no idea that this could happen.... please help.

What should we do ?? and we cant get our 10,000$ deposit back without a mutal release and with a mutal release we cant sue and with our deposit we cant look for another house....

can anyone please help **************.....

Have you asked your Realtor? What did they say? Is there some continquency that they are stating was not met?

If there is no contractual "out" for them (Hint) have YOUR attorney sue for Specific Performance.

I agree unless there is something in the contract that allows a cancellation.
