Buyer Claims Leaky Roof


What is the name of your state? GA

I recently sold my house, and the buyer is now claiming the roof leaks. It leaked once before and I had it repaired. This was fully disclosed on my disclosure statement. When I left the house, to the best of my knowledge, there were no existing roof leaks.

The buyer is now calling me asking me to file a "past insurance claim" with my insurance company. I have no desire to do this, but fear he may come back with a lawsuit.

Am I protected by my disclosure statement and the fact that the buyer had the home inspected before purchasing?

I am in Ga. After the repairs were done was the house reinspected???? Did you have some one licenced do the work? If so you could contact them for them to come out and repair the problem.

Hi, tdant.

Thanks for the advice, but the damage and repair had taken place almost two years before I sold the house, so the inspection was well after the repair ... and it was by a licensed contractor.

I would like to think that I could just send out the same guy I used before, but the buyer is now claiming that the house has "multiple leaks", and says that he needs to get the whole roof replaced. I refuse to hand over any more money to this guy. Are there any good case studies on what lawsuits disclosure statements can and cannot protect against?

**A: what exactly did you specifically disclsose with respect to this roof leak and repair issue? Post word for word.

Hi, HomeGuru.

There's an item on the disclosure that asks, "Has the roof, or any part thereof, been repaired during your ownership?" I checked "yes" and wrote a note on the last page of the disclosure which read, "Roof repair of storm damage 5/2003."
