My husband and I were to close on the purchase of a duplex and the seller did not show for closing. We have not signed a release from the contract so legally can we force him to turn the property over?
Really what we want is just to recover the appraisal fee and wash our hands of the whole thing. However, is it true that we can sue for difference in money damages? We would have ended up with over $20K in equity. The appraisal is proof of this. We are real estate investors and this really was a loss for us. How often do judgements favor the buyer in this scenario? We need to make an informed decision if we should go to small claims court or if it would be worth hiring an attorney to recover the lost equity. |
