Question

Seller didnt disclose HOA


undefinedWhat is the name of your state?KY
Seller checked the box on the sales contract stating there was no HOA when we purchased our single family home in Feb. We recieved a letter from the management company stating we owed them money for the HOA, 60 per year. Any suggestions on what we should or can do? Can I ask for 60 per year of the life of my loan (30YEARS) Please HELP!

**A: are there CC&R's recorded on title?

I never recieved any cc&r's. Where would this be? On the land title insurance company closing affidavit it states that there are no liens or encumances (hoa fees due or assessments)ON the deed it states" subject to easements, restrictions, and covenants of record" Thanks we are still waiting for a reply from the sellers. They want to know what we want bc they made a mistake.

**A: I did not ask you if you received any CC&R's. Read my post again please. And READ your response, ie. "......subject to...restrictions and covenants of record"
