Seller DisclosureWhat is the name of your state? Kentucky Hi, I was just wondering if anyone knows whether a seller is required by Kentucky state law to provide: 1) A Seller's Disclosure 2) Lead based paint disclosure My brother is purchasing a property (for sale by owner), and the seller does not wish to provide completed disclosure forms. It is unlikely that the seller would disclose anything anyways, as they have owned the property only as a rental, and have not actually lived on the property. I can't tell for sure, but a brief web search seems to indicate that a disclosure is only necessary in Kentucky if a listing agent is involved. And in this case, there is no listing agent. Whole house inspections have not turned up evidence of typical disclosure type issues (e.g. water in basement, roof leakage, sewage issues, etc.). Nevertheless, it seems that it would be nice to have a written disclosure statement from the seller. Thanks for any insight you can provide! |

Seller DisclosureThanks very much for your quick reply! Just to confirm, it does not matter whether a listing agent is involved in Kentucky, the seller must provide these disclosures regardless? Thanks again! |
