Missouri The selloer disclosed that the basement got dampness after a heavy downpour. In reality the basement leaks and floods. The seller hand wrote dampness when he could have circles leakage or flooding. Waterproofing contractors have said that the basement has leaked for years. What recourse do I have?

Should I try to send a letter to the seller informing him that I have this problem and give him the chance to take care of the financial burden before obtaining a legal suit against him ?

Absolutely. That's actually the most thoughtful way of starting out. Litigation is very stressful and it costs more for both sides, and it may be that you can come to a settlement of sorts. If not, then at least you have tried to be fair. Be sure and send any documentation with your letter backing up your claim.
