Seller failure to disclose informationWhat is the name of your state? Texas I made an offer on a home and it was accepted. Following the home inspection, we discovered several items in need of repair that were not disclosed by the owner on the Seller's Disclosure Statement. Some of these items are obvious, visible problems that the owner would have to know about. The owner refuses to pay for any repairs or lower the sales price of the home. I intend to buy the home anyway and make the repairs myself. However, I am wondering if I have any recourse against the owner after closing for failure to disclose this information. Clearly, the owner was not truthful in the disclosure. |

| AS you are closing with knowledge of thsoe defects and still are willing to buy and assume the cost of repair, it is doubtful you can prove his failure on those issues caused any loss or that knowledge would have kept you from purchasing. Obviously, you are prewarned that there may be issues the seller failed to disclose that the inspector did not discover.
